US Judge Orders Freedom of Abrego Garcia from Immigration Detention

A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks legal authority.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.

The situation originates in a erroneous deportation to El Salvador in March, which the government later admitted was an error. After his repatriation to the United States to answer human smuggling allegations, he was held in immigration custody.

In her order, the judge pointed out that the government does not have a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

Background of the Case

The court challenge involve disputed claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate criminal case in Tennessee.

Terms of Release

The court, who was overseeing his petition to removal in a Maryland district court, determined that he must now comply with the terms of his bond from jail in Tennessee. This order effectively transfers his supervision to the Tennessee court.
